Transfers out on hold

Nov 2007

There have recently been technical changes to the way in which transfer values are calculated, due to the changes imposed by legislation on pension funds in the UK. As a result, our Actuary has reviewed the basis for transfer values for people who wish to transfer their pensions out of the Coats Plan.

A new basis will take effect for all transfers requested from 1 January 2008. In the meantime, anyone who requests a transfer value before 1 January will be asked to wait until after the new terms come into force, as changes have to be made to our systems.

If you wish to receive details of your transfer value, please contact us after 1 January 2008. Please accept our apologies for any inconvenience this delay may cause.

Pensions News 16 issued
February 2006

Spring is on its way, though the Scottish weather appears to think otherwise! In addition to trying to keep warm, the Pensions Office have been working hard on Pensions News 16. This is an important edition of Pensions News as it contains information about the major changes to pensions legislation coming into force on 6 April, known as 'A' Day. In addition to the newsletter, we have produced a factsheet for our active, deferred and pensioner members, setting out the changes relevant to them. This was necessary as the legislation is incredibly detailed, and could not be covered adequately in the newsletter format.

Members of the Plan should receive their copy in early to mid March, and you can also view it online here. You can view the accompanying factsheets by clicking on our Forms & Factsheets section.

For more information about 'A' Day, please click here.

Civil Partnership Act 2004 - Effect on Pensions
21 December 2005

The Civil Partnership Act 2004 came into effect on 5 December 2005 and allows same-sex couples to enter into a formal arrangement which gives legal rights similar to marriage. As a result, there are changes to pensions law, so that pension schemes must provide the same benefits for civil partners as they provide for spouses. Members who enter into civil partnerships will now be legally entitled to pension rights in relation to their partners. (Previously under the Coats Plan, where there was no spouse, a decision to award a 'dependant's pension' was at the discretion of the Trustee, and this decision had to be based on the degree of proven financial inter-dependence between the partners.)

Note too that where a civil partnership exists, and is dissolved, the partner will acquire the same rights to a share of the member's pension as applies on the divorce of a married couple.

Any member who has entered into a civil partnership within the terms of the new legislation should write to the Pensions Office with an original copy of the civil partnership document. We also need evidence of both partners' dates of birth, if this has not already been noted on the member's record. Original copies of birth certificates should also be sent, and for anyone whose name now is different from the name on his or her birth certificate, we will also need evidence of the name change (marriage certificate or deed poll giving effect to the change).

The Pensions Office should be promptly advised if any member has a change in formal relationship, name or address, or if a new Expression of Wish is needed. Change of Address and Expression of Wish forms can be downloaded from the Forms section, and any other changes should be notified in writing - please click here for our address.

We will amend the Plan rules to take the new laws into account in due course, and we will update you on any changes.

Additional Voluntary Contributions - factor changes make the cost of pensions more expensive
28 July 2004

The Trustee has been advised by the Plan's Actuary to use new AVC factors to convert AVC funds to pension from July 2004. This reflects movements in the market generally, as well as the fact that life expectancy has improved, with the result that the pension that can be provided for the same amount of AVC fund built up has reduced.

Despite the change in rates, they remain better than the comparable standard annuity rates available from insurance companies.

Equitable Life AVC Funds to be closed
9 January 2004
In view of continuing uncertainties about Equitable Life's long-term future, the Trustee has been advised that Additional Voluntary Contributions (AVC) funds could be at greater than usual risk of loss. The Trustee does not believe this is an acceptable risk to members and has therefore decided to withdraw from Equitable Life and switch members' assets to Clerical Medical. The Trustee has responsibility for the choice of investment provider for all forms of investment under the Plan, including AVCs, and has been advised that the transfer is the most appropriate course of action to protect the interests of the Plan and its members. A full explanation has been issued to all members affected by this change.
